Until recently, it was very difficult to obtain compensation for a slip and fall on ice or snow. The injured party had to prove, often through expert testimony, that the snow or ice accumulation was not natural, but rather the result of a defect the property owner was negligent in repairing. The logic behind the law was that it’s New England, it snows, often, and people just have to be extra careful in bad weather.

However, this was a departure from the standard premises liability caselaw, that a land owner has certain duties to make their property safe, and to remedy any unsafe condition they know or should know about. Recently, the Supreme Judicial Court of Massachusetts changed the law surrounding slip and fall on ice to match more closely with all other premises liability law. Now, if an injured party can prove the landowner was negligent in failing to make their property safe from snow and/or ice accumulation, they can recover for their injuries.
