Wage Act Issues

Employment Disputes Involving Wages, Overtime, and Independent Contractors

Generally speaking, the Wage Act provides for a number of strict regulations on the payment of wages to employees, to which employers in Massachusetts must comply. For example, generally employers cannot dock the pay of an employee who arrives late any more than the amount that would have been paid to that employee during the time the employee was late. After 40 hours of work in any given week, employees must be paid one and one-half times the regular hourly rate for those excess hours. Violations of these, and the many provisions of Massachusetts Employment law, can result in significant penalties for the employer and awards of damages to the employee.

Independent Contractor or Employee?

.........................

Generally, it is extremely difficult to successfuly classify an individual as an independent contractor in Massachusetts; those employees who are incorrectly classified as independent contractors, may in fact have a legitimate civil claim against their employer. Contact this office without delay, and speak to a Massachusetts litigation attorney to evaluate your issue

Contingency Fee Attorneys

.........................

Under certain circumstances, our Massachusetts litigation attorneys can pursue your interests on a contingeny fee basis, which means you pay no legal fees unless there is a successful recovery. Obviously, this does not apply to every claim, and is only available where both our firm and the client are willing to enter into such an agreement. However, contingency fees can alleviate the burden of spending "good money" only to chase "bad money." Please contact this office without delay to discuss this potential.
